Rastrea el Virus End User License Agreement

To use the Rastrea el Virus mobile application and service (“Rastrea el Virus”, “APP”, or “App”), you must agree to this End User License Agreement (“EULA”).

Terms in this document follow definitions in the Rastrea el Virus Privacy Policy. By accepting the terms under this EULA, you agree to be legally bound by this EULA. If you do not agree to these terms, please do not use our App.

 

NO WARRANTIES

THE APP IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. USE OF THE APP IS AT YOUR OWN RISK.

 

Novel Technology

Google/Apple Exposure Notifications protocol is a novel technology interpreting Bluetooth signal strength using tuning parameters that may change from time to time based on new research. The parameters in use and the limitations of radio signals may cause the App to fail to identify and notify you of a significant contact event or exposure. Also, network and datacenter outages on a day when the App was supposed to notify you of an exposure event may cause it to fail to notify you of a significant contact event or exposure. You agree that the App developers, contributors, agents, and collaborators are not liable for failure or delay of the App to identify or notify you of a significant event or for failure to provide you with notice of such exposure.

 

Regional Usage

The App is intended for use within the geographical area that covers the archipelago of Puerto Rico.

 

Not Medical Advice

The App is not intended as a medical advice provider. You acknowledge that the information in the App is provided for general informational purposes only. It is not intended as medical advice of any kind nor is it intended to diagnose, treat, cure or prevent any disease or medical condition. The information presented in the App should not be interpreted or construed in any way as a replacement or substitute for medical advice provided by your doctor or other qualified healthcare provider. You should not disregard, avoid or delay obtaining medical advice or treatment from your doctor or other qualified healthcare provider due to any information provided in the App. Under no circumstances should you discontinue your existing medical treatment, medication regimen, or any other related healthcare activities based on any information provided in the App.

 

License

We grant you a license to use the App and the service that it provides. The service requires us to maintain servers on the Internet. This EULA covers our operation of those servers as well.

 

Applicable Law and Venue

Any dispute, claim or request for relief relating in any way to your use of the App will be governed and interpreted by the laws of the Commonwealth of Puerto Rico, without regards to any principles of conflict of laws. You agree that all actions or proceedings arising in connection with this EULA shall be tried and litigated exclusively in the local Court of First Instance located in the Municipality of San Juan, Puerto Rico, with exclusion of the U.S. District Court for the District of Puerto Rico.

 

General Provisions

You will be notified by the App if changes to this EULA are made. The App will be updated from time to time, and your acceptance of our EULA extends to all future versions. This EULA, and any rights and licenses granted under it, may not be transferred or assigned by you.
